Why Enterprises Are Increasing SOW Spend—and How to Do It Right

Next week Staffing Industry Analysts bring two flagship conferences to North America. First up is CWS Summit and then the much anticipated CollaborationX. The hype will be on AI, and in many cases rightfully so. However, a big topic will be SOW spend. This is not a new or innovative topic but hugely important in this landscape. Lets take a look at what is happening.

Operating expenditure (Opex) budgets are under pressure and capital expenditure (Capex) budgets are on the rise. Organisations are rethinking how they access external talent. One clear trend is the growing reliance on Statements of Work (SOWs).

But while SOWs promise flexibility and compliance, many enterprises are still using them in ways that create unnecessary risk, particularly around misclassification of contingent workers.

This guide explores why SOW spend is growing, where enterprises go wrong, and how a smarter approach can unlock the full value of outcome-based work.

Why SOW Spend Is Growing

  1. Opex budgets are being squeezed
Hiring full-time employees or long-term contractors from operating budgets has become harder to justify, especially in uncertain economic conditions.
  2. Capex budgets are expanding
Project-based investment is increasingly approved as Capex, meaning businesses can fund specific initiatives—cloud migrations, AI adoption, cybersecurity upgrades—without adding permanent headcount.
  3. Agility is essential
Enterprises need to scale specialist skills in and out quickly. An SOW allows this while staying compliant with tax and labour laws.

The Problem: How SOWs Are Often Misused

In many enterprises, SOWs are treated as a paperwork exercise after the fact, not a true project framework. A typical flow looks like this:

  1. A hiring manager speaks with a consultancy or recruitment firm.
  2. They create what is essentially a job description.
  3. Contractors are sourced to “fill” that role.
  4. An SOW is written up to cover the arrangement.

This backwards process is risky. It blurs the line between contingent employment and service delivery, increasing the chance of misclassification. It also means the enterprise pays consultancy mark-ups without clarity on outcomes.

The Better Way: Start With the SOW

To unlock the real value of SOWs, enterprises should flip the process:

  1. Define the SOW up front
Start by articulating the project itself—not the individual you think you need. Is it outcome-based (deliver a data strategy, build a prototype, complete a migration) or time-and-materials (X hours of development, Y days of testing)?
  2. Open the proposal process
Instead of asking for a CV, request a proposal on the best way to deliver against the SOW. This encourages suppliers to compete on innovation, efficiency, and quality rather than just cost per day. The supplier base can then be true consultancies, staffing firms etc
  3. Choose the right delivery model
Decide whether the work should be done by a consultancy team, a freelance specialist, or a hybrid model. What matters is delivering the outcome, not matching a job title.
  4. Track against milestones
Build in clear deliverables and review points. This reduces scope creep, ensures compliance, and makes budget sign-off easier.

The Payoff

By moving from job-spec-led contracting to outcome-led SOWs, enterprises can:

  • Reduce misclassification risk
  • Gain true cost visibility and control
  • Ensure spend is aligned to Capex budgets
  • Accelerate project delivery with the right mix of partners
  • Focus on outcomes instead of headcount

Conclusion

The shift from Opex-driven headcount to Capex-driven projects is here for the foreseeable future. Enterprises that embrace SOWs in the right way (defined up front, outcome-led, and tracked against milestones) will not only stay compliant but also build a more agile, cost-efficient workforce model.
